For many undocumented students in the United States, college may seem out of the question due to legal and financial obstacles. However, there are resources available that put higher education within reach.

Policies Protecting Undocumented Students

Many undocumented students fear that applying to college will risk deportation. Take solace knowing that colleges and universities cannot reveal their student’s immigration status without their permission.

You should also take note that there aren’t any federal laws that prohibit colleges from accepting students without documentation. However, some states have policies in place that make it difficult for undocumented students to apply or attend public universities. Be sure to check the policies in your own state to figure out which options are available to you.

Some of the policies that are in place to protect the rights of undocumented students include DACA (Deferred Action for Childhood Arrivals), Development, Relief, and Education for Alien Minors Act (DREAM), and Family Educational and Privacy Act (FERPA). In recent years, the Department of Homeland Security has been trying to phase out DACA, so we will continue to update this article as relevant information is released.

Achieving DACA status temporarily prevents the chance of deportation and makes it easier for students to obtain in-state tuition and college financial aid. Though the DREAM act does not apply to the entire country, there are states that have passed their own DREAM acts. This act creates financial aid funds specifically dedicated for undocumented students. Lastly, FERPA protects all students regardless of immigration status. Essentially, it gives students the rights to their educational records, meaning schools and colleges cannot release their educational records without the student’s permission.

Financial Aid Information

Unfortunately, undocumented students do not qualify for federal financial aid. However, there are colleges and universities that have scholarships and financial aid packages that may be available to undocumented students. There are even some states that make financial aid for undocumented students a priority. You may also have the opportunity to obtain financial aid from other organizations that offer scholarships. Paying for college is intimidating and sometimes even discouraging. Know that there are options to lower the pricetag!
